This pisses me off. It also makes me want to get a burner phone for that very purpose.

But I am worried that if I go over the border with a burner phone I might get suspected of something and arrested. How likely is that?

Don’t visit the United States. They’ve already demonstrated they’re willing to send legal immigrants to prison in El Salvador on unproven accusations, and Trump is on record stating he wants to send US citizens there. There’s minimal oversight or accountability for their border/ICE agents; even if visitors bring their passports everywhere, ICE could easily detain them, “lose” their passport, and claim they don’t have one and entered illegally.

#The United States is an unfriendly nation.

As per https://dailyhive.com/canada/us-canada-travel-phone even lawyers are recommending this now.

Ackah Business Immigration Law founder and managing lawyer Evelyn Ackah told Daily Hive that Canadians should leave their electronic devices behind if possible. She also suggests travellers use a burner phone (pre-paid phone) to protect their personal data from border agents.

As to what to say when asked about the obvious burner phone, I wonder if the following would help:

“Yes officer, I got a brand new phone with nothing on it to take with me. I did this because I want to comply with the laws of the USA and am afraid that if my phone got hacked I may accidentally carry something illegal across the border. I left my phone with all my lifetime photos and other history behind and I look forward to being reunited with it when my trip is over and I return home.”

You don’t owe CBP any explanation. You are under no obligation to enter your credentials or unlock your phone.

They do have the authority to seize your phone.

If you must take a phone with you:

        • buy a burner
        • set it up with a burner account (or no account if possible)
        • memorize the number of your emergency contact in the states
        • prior to landing on US soil, reset the phone (make sure you write down your flight confirmation or other important travel information)
        • as you go through security, text your emergency contact on your status. If at any point you are approached by CBP, let your contact know that if they don’t hear from you in an hour, call an attorney.

We are now in fascism times. The rule of law has no bearing on you. If you are apprehended, yell that you are being detained illegally.

If you see someone being detained, record the event, intervene non violently if you are able to. If enough of your fellow passengers are resisting, consider additional actions.

Under no circumstances should you comply in advance.

Edit: CBP not ICE. But same thing applies.

You don’t quite know what you’re talking about.

ICE doesn’t control the border, CBP does. ICE comes in after you’ve crossed the border if you’ve overstayed or entered illegally.

CBP DOES have authority to take your phone without a warrant. We’ve seen this repeatedly over the last 10 years, even hitting the courts which have ruled in CBP favour.

CBP WILL use it to deny your entry if they find something they don’t like. Just like anything else you have on you.

which is to say nothing about the fact that they’re under no obligation to actually let you in if you’re not a US citizen… comply or leave; it’s unfair, but that’s what it is to enter a foreign country

100%. Not sure where people got the idea they are entitled to enter a foreign country but most foreign countries are exactly the same, if not significantly worse.

Don’t say this. They will use that as justification to search you and your vehicle for suspicious behavior.

I hate that it’s come to the point where innocent visitors have to worry about being searched or detained, but the best thing to do is simply not travel. If you get the wrong border guard, you’re screwed either way. If you have to cross the border for whatever reason, keep your head down and don’t give them a reason to waste their time on you. Keep it short and simple by saying you’re just following travel advisories.

Ah, you’re probably right under the current regime. Open to suggestions for better phrasing like “I did this because I want to comply with the laws of the USA and also because it was suggested by the recent travel advisory issued by Canada” , except

the best thing to do is simply not travel.

100%. My advice was more for these folks,

If you have to cross the border for whatever reason

If I were in your shoes and they asked about the travel phone, I would keep it short, simple, and truthful: “I’m following Canada’s travel guidelines and using a separate phone.”

I don’t want to antagonize border agents or imply their (my) country is authoritarian, nor should I voluntarily overshare minor details (which is something liars often do). If they have an issue with me following guidelines like any other ordinary citizen, they more than likely already wanted to search me and are looking for an excuse to do it. At that point, there’s nothing you can do other than know your rights.

I’ve owned a franchise business, which is HQ’d in Canada for 14 years now, and it’s been a great experience, in no small part, due to the great colleagues up there. There have been annual seminars/conferences the entire time, held in various locations throughout the US and Canada, so nobody has to travel excessively far. I’ve enjoyed the break of a solitary road trip for several of them. This year it’s only up in Canada or via Zoom. I was actually planning on visiting some friends in Western VA, then seeing some family in PA, then more family in SD - and to drop off some (too big/expensive to ship) stuff, followed by a visit to some family in ND, then finally to the conference in Calgary.

Based on how troublesome things have gotten with the “47 shades of orange” guy, I guess it’ll be better to just stay home, and certainly cheaper. The only thing worse than having to live under the shadow of a talking Orange Julius, would be to become the victim of a crime in Canada due to my VA tags (probably not that likely), or to have difficulty returning to the US.

you’re more likely to be revered in calgary for vet tags than anywhere else in canada

have difficulty returning to the US.

if you’re a US citizen, esp by birth, you will always be admitted back to the US. your concern as a US citizen is getting IN to Canada. this is a low risk issue.
